These Terms of Service ("Terms") govern your access to and use of the website bookdwithai.com and the appointment scheduling and communication services (collectively, the "Services") provided by Invictus Marketing Group LLC, doing business as BookdAI ("BookdAI," "we," "us," or "our"). By using our Services or signing up for our SMS program, you agree to these Terms.
1. The Services
BookdAI provides appointment scheduling, confirmation, reminder, and client communication services, delivered primarily through SMS text messaging, for insurance agents, small businesses, and their clients. Use of the Services requires accurate contact information and, for SMS communications, your prior express consent as described below.
2. SMS Text Messaging Terms
2.1 Program Description
The BookdAI Appointment & Service Updates program sends recurring appointment scheduling, confirmation, reminder, and account/service update messages from BookdAI, a service of Invictus Marketing Group LLC, to individuals who have opted in.
2.2 Consent
By providing your mobile phone number and checking the consent box on our sign-up form, submitting a request through our website, or texting a keyword to our number, you provide your prior express consent to receive the messages described above at the number provided. Consent is not a condition of any purchase. You may use our Services without agreeing to receive text messages, and alternative contact methods are available by email or phone.
2.3 Message Frequency
Message frequency varies based on your appointments, requests, and account activity.
2.4 Cost
Message and data rates may apply according to your mobile carrier plan. BookdAI does not charge for text messages, but your carrier's standard messaging and data rates apply. Contact your carrier for details.
2.5 Opting Out
You can cancel the SMS service at any time by texting STOP to any message you receive from us. After you send STOP, we will send you one final SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time or reply START, and we will resume sending SMS messages to you.
2.6 Help and Support
If you are experiencing issues with the messaging program, reply with the keyword HELP to any message for assistance, or contact us directly at help@bookdwithai.com.
2.7 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and network availability.
2.8 Supported Devices
The SMS program is available on most mobile carriers and SMS-capable devices in the United States. We may suspend or terminate the program, in whole or in part, at any time without notice.
2.9 Privacy
All information collected through the SMS program is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
3. Acceptable Use
You agree not to use the Services to violate any applicable law or regulation; to provide false, misleading, or inaccurate contact information; to opt in any phone number you do not own or control; or to interfere with the operation or security of the Services.
4. Intellectual Property
The Services, including all content, branding, software, and materials on this website, are owned by Invictus Marketing Group LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without prior written permission.
5. No Professional Advice
Content provided through the Services, including scheduling communications, is for informational and administrative purposes only and does not constitute insurance, legal, financial, or other professional advice. Insurance products and advice are provided by the licensed agents and carriers you engage with, not by the BookdAI scheduling platform.
6. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.
7. Limitation of Liability
To the maximum extent permitted by law, Invictus Marketing Group LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of these Terms or the Services will not exceed one hundred U.S. dollars ($100).
8. Indemnification
You agree to indemnify and hold harmless Invictus Marketing Group LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or violation of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in St. Johns County, Florida.
